1. Acceptance of Terms

By downloading, installing, or using AI Plant Assistant ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

AI Plant Assistant is a mobile application that provides:

• AI-powered plant identification from photos
• Plant care guides and recommendations
• Pet toxicity information for plants
• Plant health diagnosis
• Care reminders and notifications
• Plant collection management

3. User Accounts

To use certain features of the App, you must create an account. You agree to:

• Provide accurate and complete information when creating your account
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

4. Subscription and Payments

4.1 Premium Subscription

AI Plant Assistant offers a Premium subscription that provides access to additional features. Subscription options include monthly and yearly plans.

4.2 Billing

Subscriptions are billed through the Apple App Store or Google Play Store, depending on your device. Payment will be charged to your account upon confirmation of purchase.

4.3 Auto-Renewal

Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

4.4 Cancellation

You can manage and cancel your subscription through your device's account settings (App Store or Google Play). Cancellation will take effect at the end of the current billing period.

4.5 Refunds

Refund requests are handled by Apple or Google, depending on your platform. Please contact Apple Support or Google Play Support for refund inquiries.

5. User Content

You retain ownership of any content you submit through the App, including photos and journal entries. By submitting content, you grant us a non-exclusive, worldwide license to use, process, and store that content solely for the purpose of providing our services to you.

6. Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Upload malicious content or attempt to interfere with the App's operation
• Attempt to gain unauthorized access to our systems
• Use the App to harass, abuse, or harm others
• Violate any applicable laws or regulations
• Reverse engineer or attempt to extract the source code of the App

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Important: Plant identification and care advice provided by the App are for informational purposes only. We do not guarantee the accuracy of plant identifications or care recommendations. Always verify plant toxicity information with a qualified professional, especially regarding pet safety.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

We are not liable for any harm to plants, pets, or property that may result from following advice or information provided by the App.

9. Intellectual Property

The App, including its design, features, and content (excluding user-submitted content), is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms in the App or on our website. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which our company is registered, without regard to its conflict of law provisions.
